A false advertising and deceptive trade practices suit is moving forward after a federal judge in Illinois determined a trophy designing company sufficiently alleged its competitor misappropriated its award design and made false statements regarding its work on a Consumer Electronics Show award.
In a Dec. 5 decision, U.S. District Judge Joan H. Lefkow for the Northern District of Illinois denied Cristaux Inc.’s motion to dismiss Lanham Act claims brought by DWM International Inc., doing business as Society Awards Inc., who alleged Cristaux violated the act by taking credit for DWM’s redesign of the Consumer Electronics Show’s (CES) Exhibitor Award.
