Dixon Financial Services, Ltd. v. Chang

The "law of the case" doctrine mandates that the ruling of an appellate court on a question of law raised on appeal will be regarded as the law of the case in all subsequent proceedings, unless clearly erroneous. The doctrine applies when the issues of law and fact are substantially the same in the second proceeding as they were in the first. Houston's 1st Court of Appeals, No. 01-07-00233-CV, 02-18-2010

In one issue, appellants, Dixon Financial Services, Ltd. (“Dixon Financial”) and Hyperdynamics Corporation (“Hyperdynamics”), contend that the trial court erred by granting summary judgment in favor of appellees, James Chang, Nick H. Johnson, Riley L. Burnett, Jr., and Johnson, Burnett & Chang, L.L.P.
