Arzola v. State

The appellant challenges his convictions for alleged sexual assault, alleged stalking and alleged unauthorized use of a motor vehicle. Testimony concerning DNA testing established the presence of DNA from a third unidentified contributor in the victim's panties, but a vaginal swab showed a sperm sample from appellant and DNA from the victim with no third contributor. The evidence is sufficient to show the appellant sexually assaulted the victim. The trial court's judgments are affirmed. Dallas Court of Appeals, No. 05-10-01137-CR, 07-06-2012.
