Goodwin v. MTD Products, Inc.

A jury's finding that a lawn mower was negligently manufactured and unreasonably dangerous was supported by a consumer's testimony that a wing nut on the mower loosened and struck him in the eye, as well as expert testimony from his treating physician and an engineer; the manufacturer's expert witness was not entitled to comment on veracity of the consumer's testimony or his credibility.

COFFEY, Circuit Judge. On June 6, 1998,Kenneth Goodwin suffered an injury to hisleft eye after being struck by a plasticwing nut discharged from the lawn mowerhe was using. Based on his injuries,Goodwin filed a product liability suitagainst MTD Products (the manufacturer ofthe lawnmower), claiming that: 1) MTDnegligently manufactured the mower; 2)the mower left MTD’s “possession andcontrol” in a defective condition; 3) themower was unreasonably dangerous; and 4)MTD breached expressed and impliedwarranties relating to the mower. Aftertrial, the jury awarded Goodwin$603,167.96 plus costs, and the judgedenied MTD’s motions for judgment as amatter of law and for a new trial. Weaffirm.
