    Employment: Victim mentality

    Employment lawyers who act for employers in discrimination and equal pay claims often have to grapple with the difficult issue of the extent to which their clients can take action such as disciplinary proceedings in relation to claimant employees without incurring liability for victimisation. But what about the risk that by playing a part in such actions, employment lawyers could themselves face victimisation claims? In Bird v Sylvester, the Court of Appeal clarified the circumstances in which lawyers who play a role in alleged acts of victimisation by their clients could face liability for aiding a discriminatory act.Victimisation in employment occurs where an employer treats an employee less favourably than an actual or hypothetical comparator, by reason that the employee took steps in connection with discrimination legislation (such as made a claim). A person who knowingly aids another to do an unlawful act of discrimination is treated as if he himself did that act.
