Maine Community Health Options v. United States. There are many ways to gauge the importance of a U.S. Supreme Court case, but one obvious measure is the amount of controversy. By that yardstick, this $12 billion case was the most important of the term. We were retained after an adverse Federal Circuit decision. The initial challenge was obtaining certiorari on issues that arise exclusively in the Federal Circuit. We pitched the case as a massive government bait-and-switch. We represented all petitioners at the podium and secured an 8-1 decision reinforcing that the federal government must make good on its statutory promises.
