The U.S. Supreme Court suggested Tuesday that a federal appeals court misstated the law when it upheld a former Chicago alderman’s conviction for making “false” statements to the Federal Deposit Insurance Corp. when his defense was that the statements were merely misleading.

However, the court also indicated that Patrick Daley Thompson’s conviction will ultimately stand because the jury was instructed to determine as a preliminary matter that his statements were in fact false.
