Electronic Wills are coming to New York. An electronic Will (an e-Will) is a Will that is created entirely online from start to finish. The e-Will uses electronic signatures instead of “wet” signatures; and is stored online.

Two pending legislative proposals A.7702 (Lavine) and S.8501 (Hoylman-Sigal) seek to amend Estates Powers and Trusts Law (“EPTL”) to authorize the execution of e-Wills. The Trusts and Estates Law Section has been working with legislative proponents to ensure that the integrity of a client’s Will is maintained, whether traditionally prepared or executed as an e-Will.
