    Overbroad Criminal Records Policies Violate Employment Law

    K.C. was released from jail in 1997, after serving a two-year jail sentence. At 21 years old, he had atoned for his crime and exited jail committed to becoming an honest member of society. Eighteen years later, he entered my office. With tears in his eyes and a broken spirit, the story he told was that of the 70 million Americans with criminal records that are currently facing the societal stigma and collateral consequences of interacting with the criminal justice system. It's a stigma that grants no reprieves and creates nearly insurmountable barriers to success. Nowhere is this more apparent than in the employment world, where over 92 percent of employers conduct criminal background checks. With those facts in mind, President Obama recently followed the lead of cities such as Philadelphia, announcing an executive action "banning the box." By delaying when the inquiry into a criminal record occurs, banning the box is a step forward in ensuring that applicants are judged by their qualifications and not prior alleged mistakes. However, it is a misnomer: the box is not banned, it is merely postponed. While many employers have removed "the box" from their applications, they have not removed it from their minds.
