In an unusual move, the Texas Supreme Court issued a stay in a $12 million insurance claim case—where neither the defendant nor plaintiff objected to a trial court denial of the execution of a pre-suit condition.
The Monday order of the high court was part of a decision to consider a petition for writ of mandamus, and included a directive that a response is due April 19.
