A class action taking aim at the city of Philadelphia for its “courtesy towing” program, which allegedly moved legally parked vehicles, is allowed to move forward, a federal judge ruled Monday.

The city of Philadelphia’s attempt to dismiss the suit for failure to state a claim was denied Monday by U.S. District Judge Mitchell S. Goldberg of the Eastern District of Pennsylvania. The court determined the plaintiffs, 15 individuals led by Mackenzie Smith, plausibly argued the city’s “vehicle relocation” program violated their rights as their believed-to-be legally parked vehicles were towed with inadequate pre- or post-notice. The plaintiffs maintain that their due process rights were violated by failing to notify the owners where the vehicles were towed, among other things.
